1. Introduction

These Terms of Service (“Terms”) govern access to and use of the Acumen62i platform and related services operated by ACUMEN F&B INSIGHTS, S.L. (“Acumen62i”, “A62i”, “we”, “our”, or “us”), including services accessible through www.acumen62i.com and www.a62i.com.

Acumen62i provides commercial intelligence, analytics, structured business information, benchmarking, market insights, and related informational tools for professional and business users.

By accessing or using the Services, users agree to these Terms.

2. Nature of the Services

Acumen62i provides an informational and analytics platform designed to support business users with structured information, analytics, benchmarking, and related decision-support functionality.

The Services are provided for informational and business intelligence purposes only and do not constitute consulting, legal advice, financial advice, strategic advisory services, or guaranteed business recommendations.

Certain functionalities, outputs, summaries, classifications, analytics, or enhancements may involve automated or AI-assisted processes.

Acumen62i does not guarantee accuracy, completeness, timeliness, commercial outcomes, or uninterrupted availability of the Services.

Customers and users remain solely responsible for evaluating and validating any business decisions made using the Services or outputs.

3. Eligibility & Business Use

The Services are intended exclusively for business and professional use by authorised users acting on behalf of organisations.

Users represent that:

  • they are authorised to access the Services where applicable;
  • information provided to Acumen62i is accurate and current;
  • and they will comply with these Terms and applicable law.

4. Access Model & Accounts

Access to the Services is controlled and subject to approval by Acumen62i.

Acumen62i may approve or reject access requests, suspend accounts, limit functionality, or revoke access at its discretion, including for security, compliance, operational, misuse, or business reasons.

Each account is assigned to a single named user. Account sharing, credential sharing, or simultaneous use of one account by multiple individuals is prohibited.

Customer organisations may request reassignment of user accounts in reasonable circumstances.

Users are responsible for:

  • maintaining confidentiality of credentials;
  • activities conducted through their accounts;
  • and promptly notifying Acumen62i of unauthorised access or security incidents.

5. Customer Organisations

Where access to the Services is provided through a subscription purchased by an organisation (“Customer”), authorised users may access the Services solely within the scope of that Customer’s subscription and authorisation.

Commercial terms, pricing, subscription duration, user limits, invoicing, and related commercial conditions may be governed by an Order Form, proposal, commercial agreement, or separate written agreement between Acumen62i and the Customer.

In the event of conflict between these Terms and a separately executed written agreement, the written agreement shall prevail solely with respect to the conflicting provisions.

6. Permitted Use

Subject to these Terms, Acumen62i grants Customers and authorised users a limited, non-exclusive, non-transferable, revocable right to access and use the Services for internal business purposes.

Users may:

  • use platform outputs internally within their organisation;
  • export limited reports or information where functionality is made available;
  • include limited excerpts, charts, graphs, insights, or screenshots in business presentations or materials;
  • and use the Services in connection with ordinary business operations.

Where platform outputs, charts, graphs, reports, screenshots, or related materials are externally shared or included in presentations, users must retain any source references, branding, copyright notices, logos, or attribution identifiers included in such materials.

Users may not remove, obscure, or alter source attribution, branding, logos, or proprietary notices associated with the Services or outputs.

All rights not expressly granted are reserved by Acumen62i.

7. Restricted Activities

Users may not, directly or indirectly:

  • scrape, crawl, harvest, or systematically extract data, information, or content from the Services;
  • use automated tools, bots, scripts, or similar technologies to access or monitor the Services;

  • or use the Services in violation of applicable law.

8. Intellectual Property & Proprietary Frameworks

The Services, including related software, content, structures, methodologies, analytics, taxonomies, classifications, frameworks, visualisations, interfaces, datasets, workflows, and related intellectual property are owned by or licensed to Acumen62i and are protected by applicable intellectual property and proprietary rights laws.

This includes, without limitation:

Acumen62i, A62i, A62i Prism, and related names, logos, marks, and branding elements may constitute trademarks or proprietary brand assets of Acumen62i or its licensors.

9. Customer Data

Customers retain ownership of Customer Data submitted to the Services.

“Customer Data” means information, materials, preferences, content, or other information submitted by Customers or authorised users in connection with use of the Services.

Customers grant Acumen62i a limited right to process Customer Data solely:

  • to provide and operate the Services;
  • maintain security;
  • improve platform functionality;
  • provide support;
  • develop analytics and aggregated insights;
  • and comply with applicable legal obligations.

Acumen62i may use aggregated, anonymised, or de-identified information for analytics, benchmarking, product improvement, operational insights, and service optimisation, provided such information does not identify individual users or Customers.
